If you do not agree, do not use the Service.

2. אופי השירות2. Nature of the Service

We provide tools for virtual polish try-on, a polish color and design gallery, a community inspiration board, a local manicurist directory, and an online appointment-booking system with manicurists on the platform.

This age requirement stems in part from the Terms of Service of Google Gemini, the AI provider we use for virtual try-on, which requires all end users to be at least 18. The legal minimum age for using digital services may differ (higher or lower) in some countries under local law, but we enforce 18+ uniformly wherever the app is available.

4. חשבונות ואבטחה4. Accounts & Security

You are responsible for account security and for all activity on your account. You may delete your account at any time through the App settings.

5. תוכן משתמשות ורישיון5. User Content & License

תמונות נסיית לק (פרטיות): תמונות הידיים שאת מעלה לעיבוד AI נשלחות לגוגל Gemini לעיבוד מיידי ואינן נשמרות אצלנו לשימוש ציבורי. מחיקת חשבון מסירה כל קישור אישי אליהן.Try-on photos (private): Hand photos you upload for AI processing are sent to Google Gemini for immediate processing and are not retained by us for public use. Account deletion removes any personal link to them.

When you choose to share a design post to the Polished community inspiration board, you grant Polished a worldwide, royalty-free, non-exclusive, transferable license to host, store, display, reproduce, modify, create derivative works of, and distribute that photo and its associated tags - solely for the purpose of operating the platform and inspiration board. You may withdraw that consent at any time by deleting the post, which removes it from the community board.

You may also delete your entire account from Settings → "Delete Account". Deleting an individual post removes that photo from the community entirely. Deleting your account triggers the process described in the next paragraph.

The image itself may be retained in the community collection as unattributed content. We do not claim that removing the identifiers automatically renders the image "non-personal" under GDPR. If a retained image can still reasonably identify you, we will treat it as your personal data and review deletion requests under applicable law. Recommendation: to remove a specific photo entirely, delete the individual post before deleting your account, or contact us at info@mypolished.com.

If a specific retained image can still reasonably identify you (for example due to distinctive tattoos, accessories, other personal markers, or combination with external data), please contact us at info@mypolished.com and we will consider your full-removal request on its merits.

As part of this:

No photos of minors' faces. No uploading photos of someone else's hands or body without their explicit consent.
• ערעור על החלטה: במקרה של הסרת תוכן או השעיית חשבון, ניתן לערער בכתובת info@mypolished.com. הערעור ייבחן בתוך 14 יום.Appealing a decision: If content is removed or an account is suspended, you may appeal at info@mypolished.com. Appeals are reviewed within 14 days.

Content that is offensive, misleading, or infringing is strictly prohibited and will be removed. At any time before deleting your account you may delete an individual community post you uploaded, and that will remove the photo entirely.

6. הודעה והסרה (DMCA / זכויות יוצרים)6. Copyright Notice & Takedown (DMCA)

7. פרופילי מניקוריסטיות7. Manicurist Profiles

מניקוריסטיות אחראיות לבדן לדיוק, לחוקיות ולאיכות של הפרופילים והעבודות שלהן. Polished אינה מתווכת בסכסוכים, אי-הגעות או ביטולים בין לקוחות למניקוריסטיות. המידע בפרופיל הוא להתרשמות בלבד ואינו מהווה המלצה של Polished.Manicurists alone are responsible for the accuracy, legality and quality of their profiles and work. Polished does not mediate disputes, no-shows, or cancellations between clients and manicurists. Profile information is for reference only and does not constitute an endorsement by Polished.

8. AI ו-AR8. AI & AR Technology

Results are virtual only. Shades, texture and real-world outcomes may differ from the simulation. Images processed by AI may receive an automatic watermark when exported outside the app.

For users who want a significantly higher daily quota, an optional monthly premium subscription is offered at $5.99 per month (or your local-market equivalent per App Store pricing). Premium subscriptions are also subject to fair-use limits - a high daily quota (currently up to 100 AI try-ons per day) plus anti-spam/abuse caps - in order to protect the system from misuse. Subscriptions renew automatically unless canceled at least 24 hours before the end of the current billing period. Payment is charged to your Apple ID. Pricing may vary by country, and local taxes may apply to the displayed price.

Please cancel your subscription via Apple ID settings before deleting your account in the app to avoid continued charges.

If you are an EU/UK consumer and believe you have a statutory 14-day withdrawal right, contact us at info@mypolished.com and we will direct you to the correct Apple refund process where applicable. Refunds on already-consumed digital subscriptions may be limited under the digital-content exceptions to consumer-withdrawal rights.

Nail polish brand names shown in the app are owned by their respective holders, used for descriptive identification only, without any implication of affiliation or endorsement.

11. הגבלת אחריות11. Limitation of Liability

האפליקציה מסופקת "כמו שהיא" ("as-is") ו"כפי שזמינה", ללא אחריות מכל סוג. איננו מתחייבות לזמינות רציפה או ללא שגיאות. במידה המרבית המותרת על פי חוק, Polished אינה אחראית לנזקים עקיפים, מקריים, מיוחדים, תוצאתיים או עונשיים. סך האחריות הכוללת שלנו כלפייך, מכל עילה, לא תעלה על הסכום ששילמת לנו ב-12 החודשים האחרונים, או 100₪ - הגבוה מבין השניים.The app is provided "as-is" and "as-available," without warranty of any kind. We do not guarantee uninterrupted or error-free service. To the maximum extent permitted by law, Polished is not liable for indirect, incidental, special, consequential or punitive damages. Our total aggregate liability to you, from any cause of action, shall not exceed the amount you paid us in the last 12 months or 100 ILS, whichever is greater.

את מסכימה לשפות את Polished מפני תביעות שצד שלישי מגיש עקב התוכן שלך, שימוש לרעה בשירות או הפרת תנאים אלה.You agree to indemnify Polished against third-party claims arising from your content, misuse of the service, or breach of these terms.

13. סיום שירות13. Termination

את יכולה להפסיק להשתמש בשירות בכל עת. Polished רשאית להשעות או לסגור חשבונות במקרה של הפרה של תנאים אלה, שימוש לרעה או כנדרש על פי חוק.You may stop using the service at any time. Polished may suspend or terminate accounts for violation of these terms, misuse, or as required by law.

14. חוק חל וסמכות שיפוט14. Governing Law & Jurisdiction

תנאים אלה כפופים לחוקי מדינת ישראל, ובכלל זה חוק הגנת הפרטיות, התשמ"א-1981, לרבות תיקון 13 שנכנס לתוקף ב-14 באוגוסט 2025. סמכות השיפוט הבלעדית לדיון בסכסוכים תהיה לבתי המשפט המוסמכים בתל אביב-יפו. צרכניות שמתגוררות באיחוד האירופי זכאיות להגנה של החוק המקומי שלהן ויכולות להגיש תביעה בבית משפט במדינת המגורים שלהן.These terms are governed by the laws of the State of Israel, including the Privacy Protection Law, 5741-1981, as amended by Amendment 13 in force since August 14, 2025. Exclusive jurisdiction for disputes lies with the competent courts of Tel Aviv-Jaffa. Consumers residing in the EU retain the protection of their local mandatory law and may bring a claim before a court in their country of residence.

14א. בוררות מחייבת וויתור על תביעה ייצוגית (לתושבי ארה"ב)14a. Binding Arbitration & Class Action Waiver (U.S. Residents)

הסעיף הזה חל על תושבי ארה"ב בלבד ומחליף, ככל שהדבר נוגע אליהם, את סעיף 14 לעיל. הוא אינו חל על תושבי ישראל, האיחוד האירופי, בריטניה או על כל מי שהחוק במדינתו אוסר על הליכי בוררות מחייבים בעניינים צרכניים.This Section applies only to U.S. residents and replaces, as it pertains to them, Section 14 above. It does not apply to residents of Israel, the EU, UK, or anywhere whose local law prohibits mandatory arbitration in consumer matters.

בוררות מחייבת. כל סכסוך, מחלוקת או תביעה הנובעים מתנאי שימוש אלה או מקשור אליהם - לרבות לעניין תקפותם, הפרתם או סיומם - ייושבו באמצעות בוררות מחייבת ופרטנית מול הצרכן (binding individual arbitration), ולא בהליך בית משפט. הבוררות תתנהל לפי כללי הבוררות הצרכנית של ה-American Arbitration Association (AAA) Consumer Arbitration Rules, על ידי בורר יחיד. הליכי הבוררות יתקיימו בשפה האנגלית, בעיר המגורים של המשתמשת או באופן וירטואלי, לפי בחירת המשתמשת.Binding Arbitration. Any dispute, controversy, or claim arising out of or relating to these Terms - including their validity, breach, or termination - shall be resolved by binding individual arbitration, not in court. The arbitration shall be administered under the AAA Consumer Arbitration Rules by a single arbitrator. Proceedings shall be conducted in English, in the user's city of residence or virtually, at the user's choice.

ויתור על תביעה ייצוגית. את ו-Polished מסכימות שכל סכסוך ינוהל אך ורק בכשירות אישית ולא ככתב תביעה ייצוגית, מאוחדת או כל הליך נציגותי אחר. בורר אינו רשאי לנהל הליך מאוחד מעבר לסכסוך של המשתמשת היחידה. במקרה שסעיף הוויתור הספציפי הזה ייפסל מסיבה כלשהי, הוא יקיים נפרד מיתר סעיף 14א.Class Action Waiver. You and Polished agree that any dispute shall be brought solely in an individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative action. The arbitrator may not consolidate proceedings beyond the individual user's claim. If this specific waiver provision is found unenforceable for any reason, it shall sever from the rest of Section 14a.

A valid opt-out returns you to the court-based path described in Section 14.

In case of any conflict between this section and the rest of the Terms, this section prevails to the extent of Apple's rights.

In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if applicable). To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App.
